Information Notice on the Processing of Personal Data

- MG Planet SA, with registered office at Schützenhausstrasse 17, 2552 Orpund, Switzerland, VAT No. CHE-113.730.717 (hereinafter “MG PLANET”), as the owner of the website associated with the internet domain names “www.maestropuccini.it” and “www.orologiotascabilecentariomaestropuccini.it/com” (hereinafter, the “Website”), by means of this information notice on the processing of personal data (hereinafter, the “Privacy Policy”), provided pursuant to Regulation (EU) 2016/679, as amended and supplemented (hereinafter, the “GDPR”), and the applicable national legislation on the protection of personal data, informs users who browse the Website (hereinafter, the “User” or “Users”) about how their personal data (hereinafter, the “Data”) are processed and enables them, where required, to give their express and informed consent to the processing of the Data.
- This Privacy Policy applies exclusively to the Website and does not apply to any third-party websites that the User may access via links available on the pages of the Website.
- By accessing and using the Website, the User acknowledges that they have carefully read this Privacy Policy and accept the purposes and methods of processing of the Data described herein. If the User does not agree with the terms set out in this Privacy Policy, they are invited to leave the Website and, in any event, to refrain from using its content and/or services
- All Data provided by the User (name, surname, email address, telephone number, etc.) are collected, stored, and processed exclusively in accordance with the GDPR.
- “Processing” of Data means any operation or set of operations, carried out with or without the aid of electronic tools, concerning the collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, dissemination, erasure, and destruction of data, including data that are not recorded in a filing system (hereinafter, the “Processing”).

- The following Data are subject to Processing:
- Browsing Data: The hardware and software of the Website automatically collect certain Data whose transmission is implicit in the use of Internet communication protocols. These are pieces of information that could, through processing and association with data held by third parties, allow the identification of Users. This category of Data includes the IP addresses of the devices used by Users connecting to the Website, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the server’s response status (successful, error, etc.), and other parameters related to the User’s operating system and computing environment. We may also receive information regarding the User’s geographic location and their electronic device.These Data are used solely to obtain anonymous statistical information on the use of the Website and to check its proper functioning, and they are deleted immediately after processing. The Data may be used to ascertain liability in the event of hypothetical cybercrimes against the Website. Data concerning the User’s geographic location may also be used to provide information, offers, and other personalized content based on location. Users who do not wish to share information about their geographic location should disable location services on their device.

- Purchase Data: When purchasing products through the e-commerce platform connected to the Website, the Data provided by the User as part of the purchase process.
- Cookies: The Website uses cookies to make the User’s browsing experience easier, faster, and more intuitive, and to ensure the proper functioning of the Website. - Purpose of the Processing
- MG Planet processes the Users’ Data for the following purposes (hereinafter, the “Purposes”)::
- To allow the creation of User profiles and the sending of emails confirming the registration of the User profile on the Website.
- To enable the purchase of products through the e-commerce platform connected to the Website and, therefore, to complete the transaction, deliver the purchased products, manage any requests for exchanges and/or returns, or issue refunds.
- For the creation of a database of Users interested in the Website and the services offered through it;
- For managing Users’ requests, whether technical, commercial, or of any other nature.
- To comply with legal obligations (including tax-related obligations) and to protect its rights.
- To send emails to Users regarding products and services similar to those requested by the User (so-called “soft spam”).
- For marketing purposes, including the sending of newsletters and/or other promotional messages via email.
- For profiling purposes, that is, analyzing preferences to create personalized content and offers.

- For the performance of contracts to which the User is a party and for the implementation of pre-contractual measures taken at the User’s request, as provided for in Article 6(1)(b) of the GDPR.
- For compliance with a legal obligation to which MG Planet is subject, pursuant to Article 6(c) of the GDPR;
- Based on the legitimate interests of MG Planet, pursuant to Article 6(f) of the GDPR;
- With the User’s prior consent, pursuant to Article 6(a) of the GDPR, for marketing and profiling purposes.
- MG Planet processes the Data:
- Methods and Location of Data Processing
- The Data are processed using automated tools for the time strictly necessary to achieve the purpose for which they were collected.
- MG Planet has implemented technical solutions and security measures that ensure the safety of the Data and prevent their alteration, loss, improper processing, or unauthorized access.
- Processing related to the services of the Website may take place on servers of third-party companies providing hosting services on behalf of MG Planet, including cloud services.
- In the event of data transfers outside the European Union, such transfers will be carried out ensuring adequate levels of Data protection, in compliance with the applicable personal data protection provisions, pursuant to Articles 45 and 46 of the GDPR.
- Communication of Data to Third Parties
- The Data collected and stored in MG Planet’s databases will be processed by its employees and/or collaborators (as well as by the employees of companies that manage all points of sale on behalf of MG Planet) as persons authorized to process such Data pursuant to Article 4(10) of the GDPR.
- The User’s Data may also be processed by third-party companies engaged by MG Planet to perform activities on its behalf (for example, analyzing data, storing data, sending newsletters or other commercial and non-commercial communications, providing marketing support, conducting market research, delivering purchased goods, managing the credit card payment platform, and other customer services).
- MG Planet provides these entities only with the Data necessary to carry out the agreed-upon activities, and they act as Data Processors pursuant to Article 4(8) of the GDPR (hereinafter, the “Data Processors”). These entities have been selected for their adequate experience, competence, and reliability, as well as their ability to ensure full compliance with applicable privacy regulations. Users may request a list of the Data Processors by writing to “info@Maestropuccini.it”.
- With regard to the scope of Data disclosure, the Data provided by the User or otherwise collected may be disclosed to the following entities or categories of entities:
- Public authorities, for the fulfillment of obligations required by law, regulations, or national or EU legislation;
- Parent companies, subsidiaries, and/or affiliates of MG Planet;
- Other companies or individuals contractually bound to MG Planet and specifically appointed to process the Data on behalf of MG Planet.
- Nature of Data Provision
- Some fields required on the Website (which may be marked with an asterisk or other symbol) may be mandatory, for example, to allow a valid registration on the Website, to provide the products the User wishes to purchase, and to process any requests.
- By entering their Data on the Website, the User guarantees that the personal information provided is accurate and up to date. Furthermore, the User acknowledges that they are solely responsible for the Data provided, whether personal data, photos, comments, or other content, and releases MG Planet from any liability.
- The provision of Data that MG Planet may process for marketing and profiling purposes is entirely optional. Refusal to consent to the processing of Data for these purposes, or subsequent withdrawal of consent, does not prevent the User from browsing the Website and/or making purchases through it.
- Withdrawal of Consent
- The User may withdraw consent for marketing activities (including the sending of newsletters) and/or profiling by MG Planet by sending an email to info@maestropuccini.it. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
- With regard to cookie management, please refer to the sections “Cookie Management” and “How to Disable and/or Delete Cookies via Browser Settings” in the Cookie Policy.
- Minors
- The newsletter service is not intended for minors under the age of 16 or for minors whose age makes the processing of their Data illegal or requires parental consent under other local laws (hereinafter, the “Age Limit”).
- MG Planet does not knowingly collect Data from minors below the Age Limit. Therefore, MG Planet asks anyone under the Age Limit not to subscribe to the newsletter and not to provide any personal data
- If you are a parent of a minor below the Age Limit and you become aware that your child has provided Data to MG Planet, please contact us by sending an email to info@maestropuccini.it. Please also note that you can exercise the rights described in the “Users’ Rights” section of the Privacy Policy.
- If MG Planet becomes aware that it has collected Data from a minor below the Age Limit, it will take reasonable steps to delete such Data.
- In any case, by registering on the Website or voluntarily providing any Data to the Website, the User confirms that they are above the Age Limit.
- Data Retention Period
- The Data processed in the course of operations are retained by MG Planet for the time strictly necessary to achieve the specific purposes of each Processing and to ensure compliance with applicable legal requirements.
- Data processed for the fulfillment of contractual obligations, including pre-contractual activities, are stored by MG Planet for 10 (ten) years from the execution of the sales contract for goods through the Website or, in the event the contract is not concluded, for the time necessary to respond to the User’s requests.
- Data processed in the context of corporate accounting and bookkeeping are retained for the period required to comply with tax obligations and the retention of accounting records.
- Data processed by MG Planet for “soft spam” activities will be retained until the User objects to such processing, which can be done by sending an email to “info@maestropuccini.it”-
- Purchase Data collected by MG Planet from the Website, with the User’s consent, for marketing and profiling purposes may be retained for up to 7 (seven) years, following a data protection impact assessment conducted by MG Planet and in accordance with the provisions of the Italian Data Protection Authority in similar sectors. After this period, MG Planet will seek to obtain new consent, and in the absence of such consent, the Data will be deleted from its database.
- The email address collected for newsletter subscription will be retained until the User withdraws consent, which can be done as described in the “Withdrawal of Consent” section of the Privacy Policy.
- With regard to the retention of data collected through cookies placed on the Website, please refer to the “Cookies Installed on the Website” section of the Cookie Policy.
- Users’ Rights
- Users may exercise at any time the rights provided under data protection legislation, pursuant to Articles 15–22 of the GDPR, including the right to:
- Obtain from the Data Controller confirmation as to whether or not personal Data concerning them are being processed and, if so, to access the personal Data, know the purposes of the processing, the categories of Data processed, the recipients or categories of recipients to whom the Data have been or will be disclosed, the Data retention period (or, if not possible, the criteria used to determine the retention period), and, where the Data were not collected from the data subject, all available information about their source, as well as the existence of any automated decision-making, including profiling (Article 15 GDPR);
- Obtain from the Data Controller, without undue delay, the rectification of inaccurate personal Data concerning them and the completion of incomplete personal Data (Article 16 GDPR);
- Obtain from the Data Controller, without undue delay, the erasure of personal Data concerning them (Article 17 GDPR);
- Obtain from the Data Controller the restriction of processing where: the data subject contests the accuracy of the personal Data pending verification by the Data Controller; the processing is unlawful and the data subject opposes the erasure of personal Data and requests restriction of their use; the personal Data are needed by the data subject for the establishment, exercise, or defense of a legal claim; the data subject has objected to processing pending verification of whether the legitimate grounds of the Data Controller override those of the data subject (Article 18 GDPR).
- Receive from the Data Controller the personal Data concerning them and transmit such Data to another Data Controller without hindrance from the original Data Controller (Article 20 GDPR);
- Object at any time, for reasons related to their particular situation, to the processing of personal Data concerning them pursuant to Article 6(1)(e) and (f) and for direct marketing purposes, including profiling on such grounds (Article 21 GDPR);
- Not be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them (Article 22 GDPR);
- Lodge a complaint with the competent supervisory authority.
- Requests to exercise the rights referred to in the previous article should be sent by email to the contact address of the Data Controller.
- Requests related to the exercise of rights will be addressed without undue delay and, in any case, within one month of the request. This period may be extended by a maximum of 2 (two) months if necessary, taking into account the complexity and number of requests. In such a case, the Data Controller will inform the data subject of the extension and the reasons for the delay within one month of receiving the request. If the Data Controller does not comply with the User’s request, the Data Controller will inform the User without delay, and at the latest within one month of receiving the request, of the reasons for non-compliance and of the possibility to lodge a complaint with a supervisory authority and to seek judicial remedy.
